Terms of Service

These Terms ("Terms") govern your use of WAM ERP. By signing up, you accept them.

1. The service

WAM ERP is a cloud-based manufacturing ERP. We provide the software, you provide the data. You own your data; we are a data processor under the DPDP Act.

2. Your account

• You must be 18+ and authorized to bind your company.
• Keep your password safe. You're responsible for actions taken from your account.
• One paid subscription per legal entity, unless on Enterprise multi-company plan.

3. Plans, payment & trial

• 14-day free trial — no card required.
• Paid plans bill in advance. UPI AutoPay / Card / Net Banking via Razorpay.
• Annual plans are non-refundable except under the 30-day money-back guarantee (see §4).
• Prices exclusive of 18% GST. We issue a tax invoice with your GSTIN.
• We reserve the right to revise pricing with 30 days' notice for renewals.

4. 30-day money-back guarantee

For any first-time paid plan: if you're not satisfied within 30 days of payment, message us on WhatsApp or email refund@wamerp.com for a full refund within 48 hours. No questionnaire.

5. Acceptable use

Don't:

• Use WAM ERP to commit fraud, tax evasion, or any illegal act.
• Reverse-engineer, resell, or sub-license the software.
• Attempt to access other tenants' data.
• Send spam from our SMTP relay or webhooks.

6. Uptime & support

• Target uptime: 99.9% monthly (Pro & Enterprise carry SLA credits).
• Planned maintenance announced 48 hours in advance.
• Support response SLA varies by plan (see Pricing page).

7. Data, backups & exit

• You can export all data anytime, free, in CSV / Excel / JSON.
• We retain a 30-day rolling backup; tested restore quarterly.
• On cancellation, your data is retained 30 days then permanently deleted.

8. Confidentiality & IP

You retain ownership of your data. We retain ownership of the WAM ERP software, templates, and documentation. Mutual NDA applies on the Enterprise plan.

9. Limitation of liability

To the maximum extent permitted by law, WAM ERP's total liability under these Terms is capped at the amount you've paid us in the preceding 12 months. We are not liable for indirect, consequential, or punitive damages.

10. Termination

Either party may terminate with 30 days' notice. We may terminate immediately for breach of §5 (Acceptable Use) or non-payment beyond 30 days.

11. Governing law & jurisdiction

These Terms are governed by the laws of India. Exclusive jurisdiction: courts of Pune, Maharashtra.

12. Changes

Material changes get 30 days' email notice. Continued use after the effective date = acceptance.
